The Four Flood Zone Types Affecting Buffalo-Area Properties

Zone AE — High Risk SFHA
The base flood zone in FEMA’s mapping. Defined as land that has a 1% annual chance of flooding — the “100-year floodplain.” Detailed hydraulic analysis has been conducted and Base Flood Elevations (BFEs) are established for this zone.
Insurance requirement: Mandatory flood insurance for any property with a federally backed mortgage (FHA, VA, conventional through Fannie/Freddie). Typically purchased through the NFIP or private flood market. This is the most common high-risk zone designation in WNY creek and waterway corridors.

Also part of the Special Flood Hazard Area with a 1% annual flood chance, but without detailed hydraulic study — BFEs have not been established. Older FIRM maps for some Erie County areas use Zone A rather than AE.

Moderate flood hazard — between 0.2% and 1% annual flood chance (the “500-year floodplain”). Outside the SFHA. Flood insurance is not federally required but is strongly recommended.
Insurance requirement: No mandatory requirement. Buyers can purchase flood insurance voluntarily at lower preferred risk rates. Common in areas adjacent to Zone AE in WNY — properties close to Cazenovia Creek, Ellicott Creek, and Tonawanda Creek tributaries.
Moderate risk — No mandate, insurance recommendedZone X Unshaded — Minimal Risk
Minimal flood hazard — outside the 0.2% annual chance floodplain. Most of the Buffalo metro is in Zone X unshaded. No flood insurance requirement, no SFHA designation.
Insurance requirement: None. Flood insurance is available at preferred risk rates for those who want it. Properties reclassified from AE to X following a LOMA or LOMR may be eligible for preferred risk rates.

Mandatory Flood Insurance for Financed Buyers
Any buyer using a federally backed mortgage — FHA, VA, USDA, or conventional through Fannie Mae or Freddie Mac — is required by federal law to purchase and maintain flood insurance for the life of the loan on a Zone AE property. This requirement does not go away at resale. The buyer must have coverage in place before closing. NFIP coverage for a Zone AE property in WNY typically runs $800–$2,500+ per year depending on the structure’s elevation relative to the Base Flood Elevation. An Elevation Certificate establishes whether the structure is above, at, or below BFE — the single biggest factor in NFIP premium.
Elevation Certificate — Required or Strongly Advised
A FEMA Elevation Certificate (EC) documents the lowest finished floor elevation of the structure relative to the BFE. Without an EC, the NFIP rates the policy at the worst-case assumption, producing the highest possible premium. With an EC showing the structure is above BFE, premiums drop significantly. If your property is in Zone AE and you do not have an EC, buyers and their lenders will require one. ECs are prepared by licensed land surveyors and cost $300–$800 in Erie County. Lender Appraisal and Insurer Disclosure Requirements
In NY, sellers are required under the Property Condition Disclosure Act to disclose known flood zone status and prior flood damage. Lenders require the appraiser to note flood zone designation. If the property is in Zone AE and the current policy is being assumed by the buyer, federal law requires the seller to notify the buyer in writing before closing. These disclosure requirements do not prevent a sale — they require transparency. Non-disclosure creates legal liability.
Policy Assumption vs. New Policy
NFIP policies are assignable to a new buyer under certain conditions. Assuming an existing NFIP policy with a grandfathered rate can save the buyer significant premium costs — particularly if the property was mapped into Zone AE after the original policy was written and the policy is Pre-FIRM. Talk to your flood insurance agent about whether your existing policy is assumable and whether assumption saves the buyer money. This can be a meaningful selling point that differentiates a Zone AE property in a competitive Erie County market.
Check your zone first: Many WNY homeowners believe they are in Zone AE based on a prior assessment but have not confirmed against the current FIRM panel. Erie County flood maps have been updated in recent years — some properties have been added to SFHA zones, others removed. Verify your current designation at msc.fema.gov before listing. A Letter of Map Amendment (LOMA) can remove a property from Zone AE if FEMA’s mapping placed it there in error — this can meaningfully change a property’s insurance cost and buyer pool.
